(1) On the
determination of an appeal under section 85(1), (2)(a) or (4) the Supreme
Court may by order —
(a)
confirm the Commissioner’s decision; or
(b) vary
the Commissioner’s decision; or
(c) set
aside the Commissioner’s decision and —
(i)
make a decision in substitution for that decision; or
(ii)
remit the matter to the Commissioner for reconsideration
with any direction or recommendation the Supreme Court thinks fit.
(2) On the
determination of an appeal under section 85(2)(b) the Supreme Court may order
that an exemption certificate no longer apply to a document.
(3) If it is
established that a document is an exempt document the Supreme Court does not
have power to make a decision to the effect that access is to be given to the
document.
