(1) For the purpose of
constructing any underground work, an interest in land under the surface may
be taken under this Part without taking any interest in the surface.
(2) In such a case no
compensation is payable unless —
(a) the
surface of the overlying soil is disturbed; or
(b) the
support to the surface is destroyed or injuriously affected; or
(c) a
mine, underground working, spring, reservoir, dam, or well in or adjacent to
the land is injuriously affected,
by the construction of
the work.
