(1) In this section
—
category 1 vehicle means a vehicle that on the day
of the sale —
(a) is
not more than 10 years old; and
(b) has
been driven for not more than 150 000 km;
category 2 vehicle means a vehicle that on the day
of the sale —
(a) is
more than 10 years but not more than 12 years old; or
(b) has
been driven for more than 150 000 km but not more than 180 000 km;
vehicle means a vehicle to which this Division
applies other than a motor cycle.
(2) In the case of a
category 1 vehicle, the dealer is responsible under section 34 for a defect
that appears in the vehicle before —
(a) the
vehicle has been driven for 5 000 km after the sale; or
(b) the
expiry of the period of 3 months following the day of the sale,
whichever happens
first.
(3) In the case of a
category 2 vehicle, the dealer is responsible under section 34 for a defect
that appears in the vehicle before —
(a) the
vehicle has been driven for 1 500 km after the sale; or
(b) the
expiry of the period of one month following the day of the sale,
whichever happens
first.
