(1) If there is an
inconsistency between —
(a) a
local planning scheme in force in a regional order area, or a local law in
force in a regional order area under the Local Government Act 1995 and the
Local Government (Miscellaneous Provisions) Act 1960 ; and
(b) a
regional interim development order in force in respect of the regional order
area,
the regional interim
development order prevails over that local planning scheme or local law to the
extent of the inconsistency.
(2) If there is an
inconsistency between —
(a) a
local planning scheme in force in a local order area, or a local law in force
in a local order area under the Local Government Act 1995 and the
Local Government (Miscellaneous Provisions) Act 1960 ; and
(b) a
local interim development order in force in respect of the local order area,
the local interim
development order prevails over that local planning scheme or local law to the
extent of the inconsistency.
