(1) The Minister may,
by instrument, delegate to a person or body any function of the Minister under
this Act, except this power of delegation.
(2) The Minister is to
cause the name or title of the delegate to be published in the Gazette as soon
as is practicable after the making of the delegation concerned.
(3) A delegate cannot
subdelegate the exercise or performance of any function unless the delegate is
expressly authorised by the instrument of delegation to do so.
(4) A delegate
exercising or performing a function as authorised under this section is to be
taken to do so in accordance with the terms of the delegation unless the
contrary is shown.
(5) Nothing in this
section limits the ability of the Minister to act through an officer or agent.
