(1) At a hearing fixed
under section 26(2) the applicant may provide evidence by affidavit in support
of the application and the court must accept such affidavit in support of the
matters alleged in the application and may determine the application on that
evidence.
(2) The court may
accept a faxed copy of an affidavit if it considers it appropriate.
