RESIDENTIAL TENANCIES ACT 1987 - SECT 34

34 .         Proper records of rent to be kept

        (1)         A lessor shall keep, or cause to be kept, a record in accordance with subsection (2A) showing the rent received in respect of the premises.

        Penalty for this subsection: a fine of $5 000.

        (2A)         The record should specify all of the following —

            (a)         the fact that the payment is for rent;

            (b)         the date the rent is received;

            (c)         the name of the person paying the rent;

            (d)         the amount paid;

            (e)         the period in respect of which it is paid;

            (f)         the premises in respect of which it is paid.

        (2)         No person shall make in any record referred to in subsection (1) any entry that the person knows is false or misleading in a material particular.

        Penalty for this subsection: a fine of $5 000.
