(1) If a lessor
suspects on reasonable grounds that the tenant has abandoned the residential
premises, the lessor may apply to a competent court for an order under this
section.
(2) The lessor may
make the application instead of giving a notice under section 76A to the
tenant.
(3) If an application
is made, the court may make an order declaring that the premises were
abandoned by the tenant on the day stated in the order.
(4) If the court makes
an order under subsection (3), the tenant is taken to have abandoned the
premises on the day stated in the order.
