(1) Every proprietor
of a lot on a strata plan is entitled to have his lot sheltered by all such
parts of the building as are capable of affording shelter.
(2) The right created
by subsection (1) is an easement to which such parts of the building as
are referred to in that subsection shall be subject.
(3) The easement of
shelter created by this section entitles the proprietor of the dominant
tenement to enter on the servient tenement to replace, renew or restore any
