(1) Land becomes
subject to an easement or restrictive covenant noted on a plan in accordance
with this Part —
(a) in
the case of a scheme plan lodged for registration under the
Community Titles Act 2018 or the Strata Titles Act 1985 , at the time the
Registrar registers the scheme plan under that Act; and
(b) in
any other case, at the time the new certificate, or if more than one, all the
new certificates, for the land the subject of the plan have been registered.
(2) Where an
instrument is lodged under this Part in relation to a plan, the instrument
shall be deemed to be registered for the purposes of section 58 at the time
the land becomes subject to the easement or restrictive covenant under
subsection (1).
