(1) A devisee or
person claiming any estate of freehold in possession or a power to appoint
transfer or dispose of the same on a transmission may make application in
writing to the Commissioner to be registered as proprietor thereof and shall
produce the will or an office copy or probate of the will of the deceased
proprietor or letters of administration with his will annexed or the letters
of administration in case of intestacy or the settlement under which such
applicant claims and shall afterwards furnish such other evidence as may be
deemed necessary.
(2) Such application
shall state the nature of every interest held by any other person at law or
equity in the land within the applicant’s knowledge and that he verily
believes himself to be entitled to the estate in or power over such land in
respect to which he applies to be registered and shall also state the value of
the property.
