(1) This regulation
applies to a residential tenancy agreement that creates a tenancy for a fixed
term expiring on or before the day that is 30 days after the day on which
the Residential Tenancies Amendment Act 2011 section 59(1) comes
into operation.
(2) Under
section 6(a) of the Act it is provided that section 60(1) of the Act
shall apply to a residential tenancy agreement as if it were modified by
deleting paragraph (b) and inserting:
(b) in
the case of a tenancy for a fixed term, where the term expires
and —
(i)
the tenant delivers up vacant possession of the premises
on or after the expiration of the term; or
(ii)
a competent court, upon application by the lessor,
terminates the agreement under section 72;
