(1) This regulation
applies to a residential tenancy agreement that creates a tenancy for a fixed
term expiring on or before the day that is 30 days after the day on which
the Residential Tenancies Amendment Act 2011 section 71(1) comes
into operation.
(2) Under
section 6(a) of the Act it is provided that section 72 of the Act
shall apply to a residential tenancy agreement as if it were modified by
deleting subsections (1A) and (1) and inserting:
(1) If an agreement
creates a tenancy for a fixed term and the tenant fails to deliver up
possession of the premises on or after the expiration of the term, the lessor
may, within 30 days after the expiration of the term, apply to a
competent court for an order terminating the agreement and an order for
possession of the premises.
