(1) In this
section —
“declaration” means a declaration made
under section 11, 12 or 22(2).
(2) A declaration is
not subsidiary legislation for the purposes of the
Interpretation Act 1984 .
(3) The
Interpretation Act 1984 sections 43 (other than subsection (6))
and 44 and Part VIII apply to a declaration as if it were subsidiary
legislation.
(4) Publication of a
declaration must be effected —
(a) by
publishing the declaration in the Gazette ; or
(b) by
publishing in the Gazette a notice stating that the declaration has been made
and that particulars of the declaration may be obtained from the head office
of the department and the department’s electronic site.
