(1) It is a term of a
site-only agreement that the long-stay tenant is entitled to sell a
relocatable home owned by the tenant while it is in place on the agreed
premises, unless the agreement expressly provides that on site sales are
prohibited.
(2) The long-stay
tenant is entitled to display a “for sale” sign, but must comply
with any term of the site-only agreement or the park rules that reasonably
restricts the size and placement of the sign.
(3) Before offering
the relocatable home for sale, or displaying a “for sale” sign,
the long-stay tenant must tell the park operator of the tenant’s
intention to offer the home for sale while it is on the agreed premises.
(4) If the long-stay
tenant is permitted under the site-only agreement to assign the tenant’s
rights under the agreement to a third party, the tenant must also tell the
park operator whether the tenant intends to assign those rights to the
purchaser of the relocatable home.
