A Bill for

An Act to amend the Land (Planning and Environment) Act 1991











The Legislative Assembly for the Australian Capital Territory enacts as follows:



1 Name of Act

This Act is the Land (Planning and Environment) Amendment Act 2002.

2 Commencement

This Act commences on the day after its notification day.

3 Act amended

This Act amends the Land (Planning and Environment) Act 1991.

4 Minor amendments

Section 247 (2) (c)

substitute

(b) will not cause an increase in detriment to any person or the environment; and

5 Section 247 (2) (d)

renumber as section 247 (2) (c)

6 Section 247 (3) (c)

substitute

(c) to each person who had objected under section 237 (Objections—general) to the grant of the approval; and

(d) to any relevant Territory authority.

7 New section 247 (4) and (5)

insert

(4) Subsection (2) (b) as inserted by the Land (Planning and Environment) Amendment Act 2002 does not apply to applications under subsection (1) made before the commencement of that Act.

(5) Subsection (4) and this subsection expire 6 months after their commencement.
