A Bill for

An Act to amend legislation about loose-fill asbestos









The Legislative Assembly for the Australian Capital Territory enacts as follows:

Part 1 Preliminary

1 Name of Act

This Act is the Loose-fill Asbestos Legislation Amendment Act 2021

.

2 Commencement

This Act commences on 18 August 2021.

Note The naming and commencement provisions automatically commence on the notification day (see Legislation Act

, s 75 (1)).

3 Legislation amended

This Act amends the following legislation:

Civil Law (Sale of Residential Property) Act 2003

Dangerous Substances Act 2004

Government Agencies (Land Acquisition Reporting) Regulation 2019

Planning and Development Regulation 2008

Section 6 (4), definition of buyback scheme

substitute

buyback scheme means the scheme involving the acquisition by the Territory of residential premises that contain or have contained loose-fill asbestos insulation.

213 Meaning of loose-fill asbestos insulation eradication buyback program

In this regulation:

loose-fill asbestos insulation eradication buyback program (LAIE buyback program) means the program involving the surrender to the Territory of affected leases.
