A Bill for

An Act to amend the Long Service Leave Act 1976, the Long Service Leave (Building and Construction Industry) Act 1981 and the Long Service Leave (Contract Cleaning Industry) Act 1999











The Legislative Assembly for the Australian Capital Territory enacts as follows:



Part 1 Preliminary

1 Name of Act

This Act is the Long Service Leave Legislation Amendment Bill 2003.

2 Commencement

This Act commences on the day after its notification day.

Note The naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).



Part 2 Long Service Leave Act 1976

3 Act amended—pt 2

This part amends the Long Service Leave Act 1976.

4 Section 9

substitute

9 Public holidays not to count as leave

(1) This section applies if a public holiday or an award holiday falls during a period of long service leave taken by an employee.

(2) The period of long service leave is increased by 1 day for each such holiday.

5 Pro rata long service leave entitlement

Section 11C (1) (b)

not less than 7 years

substitute

at least 5 years



Part 3 Long Service Leave (Building and Construction Industry) Act 1981

6 Act amended—pt 3

This part amends the Long Service Leave (Building and Construction Industry) Act 1981.

7 Section 58

substitute

58 Public holidays not to count as leave

(1) This section applies if a public holiday or an award holiday falls during a period of long service leave taken by a registered employee or a contractor.

(2) The period of long service leave is increased by 1 day for each such holiday.



Part 4 Long Service Leave (Contract Cleaning Industry) Act 1999

8 Act amended—pt 4

This part amends the Long Service Leave (Contract Cleaning Industry) Act 1999.

9 Section 59

substitute

59 Public holidays not to count as leave

(1) This section applies if a public holiday or an award holiday falls during a period of long service leave taken by a registered employee.

(2) The period of long service leave is increased by 1 day for each such holiday.

(3) In this section:

award holiday means a day that is a holiday for people employed in the contract cleaning industry because of an award or agreement.
