Outline
The Victims of Crime Amendment Act 2007
introduces a $10 levy on all offences, except parking offences, where a
court fine is imposed. Part of the scheme also includes the Department of
Territory and Municipal Services (TAMS) increasing traffic infringement notice
penalties by $10. This has been achieved by amending the Road Traffic
(Offences) Regulation 2005. The penalty increase does not apply to parking
offences.
Two offences that should not attract the $10 levy do not appear
in the list of excluded offences in the Act. The offences are items 35 and 36
of the Road Transport (Safety and Traffic Management) Regulation 2000.
Offence 35 relates to displaying a thing falsely resembling a parking ticket.
Offence 36 relates to displaying a changed/damaged/defaced parking
ticket.
This Regulation rectifies this matter by amending the Victims
of Crime Regulation 2000 to include these offences as prescribed offences in
Schedule 1, Part 1.2 – see items 15 and 16 of Schedule 1, Part 1.2.
The Regulation is made under section 23 of the Victims of Crime Act
1994, which empowers the Executive to make regulations for the
Act.
Clause 1 Name of Regulation
This clause names
the regulation as the Victims of Crime Amendment Regulation 2007 (No
1).
Clause 2 Commencement
This clause states
that this regulation commences immediately after the commencement of the
Victims of Crime Amendment Act 2007.
Clause 3
Legislation amended
This clause states that this regulation amends
the Victims of Crime Regulation 2000.
Clause 4 Schedule
1, part 1.2
This clause omits Schedule 1, part 1.2 of the Victims
of Crime Regulation 2000, and substitutes a new Schedule 1, part 1.2.
Schedule 1, part 1.2 now includes items 14 and 15, which had been omitted from
the previous Schedule 1, part 2.
