The Parliament of Australia enacts:

1 Short title
5
This Act is the Australian Institute of Health and Welfare
6
Amendment (Assisted Reproductive Treatment Statistics) Act 2019.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

accredited ART centre has the meaning given by section 8 of the
6
Research Involving Human Embryos Act 2002.
7
assisted reproductive treatment means medical treatment or a
8
procedure that procures, or attempts to procure, pregnancy in a
9
woman by means other than sexual intercourse, and includes:
10
(a) in-vitro fertilisation; and
11
(b) gamete intrafallopian transfer; and
12
(c) intracytoplasmic sperm injection; and
13
(d) artificial insemination; and
14
(e) oocyte donation; and
15
(f) any related treatment or procedure prescribed by the
16
regulations.

Part IIA--Statistical information from accredited

ART centres relating to assisted

reproductive treatments

19A Accredited ART centres must give certain statistical
5
information to the Institute
6
(1) An accredited ART centre must give to the Institute within 2
7
months after the end of a financial year the following statistical
8
information:
9
(a) the number of women given assisted reproductive treatment
10
by the centre during the financial year, and the age of those
11
women;
12
(b) the types of assisted reproductive treatment given by the
13
centre and the number of times each type of treatment was
14
given by the centre during the financial year;
15
(c) the number of pregnancies in the financial year that are
16
reasonably attributable to the assisted reproductive treatment
17
given by the centre (whether or not the treatment occurred in
18
that year);
19
(d) the number of live births in the financial year as a result of
20
pregnancies reasonably attributable to the assisted
21
reproductive treatment given by the centre (whether or not
22
the treatment occurred in that year);
23
(e) any other statistical information specified in the regulations
24
that relates to assisted reproductive treatment given by the
25
centre.

(2) An accredited ART centre commits an offence of strict liability if
27
the centre contravenes subsection (1).

Penalty: 70 penalty units.

19B Publication of statistical information relating to accredited ART

centres etc.

Statistical information relating to accredited ART centres

(1) If the Institute receives statistical information from an accredited
4
ART centre under section 19A, the Institute must cause the
5
information to be published as soon as reasonably practicable after
6
receiving the information.
7
(2) In causing the publication of statistical information under
8
subsection (1), the Institute must ensure the accredited ART centre
9
to which the information relates is specified in the publication.

List of non-complying accredited ART centres
11
(3) The Institute must, as soon as reasonably practicable after the
12
period for an accredited ART centre to give statistical information
13
under section 19A has ended, cause a list to be published
14
identifying any accredited ART centres that did not give the
15
information within that period.

Miscellaneous
17
(4) The Institute may publish the statistical information or the list in
18
such manner as the Institute thinks appropriate.
19
(5) Without limiting subsection (4), the Institute may cause the
20
publication of the statistical information and the list in the form of
21
an electronic database that is accessible online.
22
(6) The Institute must not include in the publication of the statistical
23
information or the list any information that is likely to enable the
24
identification of an individual, unless the individual is an
25
accredited ART centre.

4 Application provision
27
Section 19A of the Australian Institute of Health and Welfare Act 1987,
28
as inserted by this Schedule, applies in relation to the financial year
29
starting on 1 July 2019 and each later financial year.
