Clause 1 Surface Coal Mining Prohibition (Lake Macquarie) Bill 2009 The Legislature of New South Wales enacts: 1 1 Name of Act 2 This Act is the Surface Coal Mining Prohibition (Lake Macquarie) 3 Act 2009. 4 2 Commencement 5 This Act commences on the date of assent to this Act. 6 3 Definitions 7 In this Act: 8 surface coal mining means the operation of a coal mine that is not an 9 underground mine. 10 underground mine means a coal mine in which persons are employed 11 beneath the earth's surface when the mine is being worked and in which 12 the working environment is completely enclosed by the geologic 13 medium. 14 4 Prohibition of surface coal mining in Lake Macquarie City 15 (1) Surface coal mining is prohibited in the local government area of Lake 16 Macquarie City. 17 (2) Subsection (1) does not apply to the area identified as "existing 18 Westside open cut mine" shown at the commencement of this section 19 on the map marked "State Environmental Planning Policy (Mining, 20 Petroleum Production and Extractive Industries) 2007--Map 1--Lake 21 Macquarie" (being a map that is approved and signed by the Minister 22 for Planning and copies of which are deposited in the head office of the 23 Department of Planning and publicly available on that Department's 24 website). 25 (3) This Act is to be construed as if it formed part of the Environmental 26 Planning and Assessment Act 1979. 27 Page 2 Surface Coal Mining Prohibition (Lake Macquarie) Bill 2009 Clause 4 (4) This Act applies despite any other Act or law (including any 1 environmental planning instrument) to the contrary. 2 Page 3
