Application of Law to partnerships and eligible associations and other entities
286 Application of Law to partnerships and eligible associations and other
entities
(1) If this Law would otherwise require or permit something to be done by a
partnership, the thing may be done by one or more of the partners on behalf of
the partnership.
(2) If this Law would otherwise require or permit something
to be done by an eligible association, the thing may be done by one or more of
the members of the executive committee on behalf of the association.
(3) If
this Law would otherwise require or permit something to be done by a
prescribed entity, the thing may be done by one or more of the persons with
management or control of the entity on behalf of the entity.
(4) An offence
against this Law that would otherwise be committed by the partnership is taken
to have been committed by each partner who is a person with management or
control of the partnership.
(5) An offence against this Law that would
otherwise be committed by an eligible association is taken to have been
committed by each person who is a person with management or control of the
association.
(6) An offence against this Law that would otherwise be
committed by a prescribed entity is taken to have been committed by each
person who is a person with management or control of that entity.
(7) The
penalty for an offence that is taken to be committed under this section is the
penalty applicable to an individual.
