The Legislative Assembly of the Northern Territory enacts as follows:


1. Short title
This Act may be cited as the Evidence Amendment Act 2004.

2. Commencement
This Act comes into operation on the date fixed by the Administrator by notice in the Gazette.

3. Evidence of vulnerable witnesses
Section 21A of the Evidence Act is amended by omitting subsections (2A) and (2B) and substituting the following:

"(2A) The Court may make an order that the vulnerable witness is not to give evidence using an arrangement under subsection (2) if satisfied that, because of the urgency of the proceeding, it is impracticable to give effect to that arrangement.".
