CIVIL PROCEEDINGS ACT 2011 - SECT 59
Interest after money order
(1) This section applies in relation to a money order except to the extent the
court otherwise orders.
(2) Interest is payable from the date of the
money order on the money order debt.
(3) The interest is payable at the rate
prescribed under a practice direction made under the
Supreme Court of Queensland Act 1991 .
(4) However— (a) if— (i) the
money order is for payment of a stated amount for damages or costs; and
(ii)
the amount is paid in full within 21 days after the date of the order;
interest on the damages or costs is not payable; and
(b) if— (i) the
money order is or includes an order for the payment of costs in an amount to
be ascertained, under the rules or otherwise, after the order is made; and
(ii) the amount for costs is paid in full within 21 days after the day the
amount has been ascertained and becomes payable under the rules or otherwise;
interest on the costs is not payable.
(5) This section does not apply in
relation to a proceeding for a cause of action arising before 21 December
1972.
(6) In this section—
"money order" — (a) includes an order for the payment of costs in an amount
to be ascertained, under the rules or otherwise, after the order is made; and
(b) does not include an order of the registrar, made under the rules, about
the amount payable for costs under a money order.
"money order debt" , for a money order for the payment of costs in an amount
to be ascertained after the order is made, means the amount ascertained under
the rules or otherwise.
