TRANSPORT OPERATIONS (ROAD USE MANAGEMENT) ACT 1995 - SECT 104
Off-street regulated parking areas
(1) An
"off-street regulated parking area" is an area of land, including any
structure on the land, that— (a) is controlled by the chief executive or a
local government; and
(b) is specified as an
off-street regulated parking area under— (i) a regulation; or
(ii) for a
local government—a local law.
(2) Land controlled by the chief executive or
a local government includes land over which the chief executive or local
government may exercise control for the purposes of this part under an
arrangement with a person who owns, or has an interest in, the land.
Example— The chief executive may, under an arrangement with the owner of a
shopping centre, regulate the use of the shopping centre’s public parking
area that has been specified to be an off-street regulated parking area under
a regulation.
(3) An agreement to give effect to the arrangement for the
area must provide for the matters prescribed under a regulation.
