Post-entry approval
29A Post-entry approval
(1) As soon as reasonably practicable after exercising evidence preservation
powers, an authorised officer must apply in writing to a magistrate for an
order approving the exercise of the powers (
"post-entry approval order" ).
(2) The application must be sworn and state
the grounds on which it is sought.
(3) The authorised officer need not appear
at the consideration of the application, unless the magistrate otherwise
requires.
(4) The magistrate may refuse to consider the application until the
authorised officer gives the magistrate all the information the magistrate
requires about the application in the way the magistrate requires. Example—
The magistrate may require additional information supporting the application
to be given by statutory declaration.
