A person who has care or charge of livestock that are to be transported must ensure that the livestock –

(a) are safely mustered and assembled in preparation for transportation in a manner that is appropriate for the livestock; and

(b) are handled in a manner that is safe and appropriate for the livestock; and

(c) have access to food and water, if appropriate –

(i) while the livestock are mustered and assembled in preparation for transportation; and

(ii) before the livestock are transported; and

(d) are not held at mustering, or assembly, points for excessive periods before transportation.

Penalty:  In the case of –

(a) a body corporate, a fine not exceeding 100 penalty units; and

(b) an individual, a fine not exceeding 50 penalty units.
