LAND LEGISLATION AMENDMENT ACT 2009 (NO. 80 OF 2009) - SECT 40

At the end of section 75A of the Transfer of Land Act 1958 insert —

    "(2)     For the purposes of this section, the variation of a mortgage does not include the following—

        (a)     a transfer or assignment of a mortgage; or

        (b)     an alteration of—

              (i)     the length of the term of the mortgage; or

              (ii)     an area of mortgaged land; or

              (iii)     the parties to a mortgage.".
