SOCIAL SERVICES REGULATION ACT 2021 (NO. 37 OF 2021) - SECT 242

    (1)     A provider must not request a resident to pay a fee in advance greater than—

        (a)     the equivalent of one month's fees; or

        (b)     if an amount is prescribed for the purposes of this subsection, that prescribed amount.

Penalty:     60 penalty units, in the case of an individual;

    300 penalty units, in the case of a body corporate.

    (2)     A provider must not, unless the resident requests in writing, accept in respect of a resident a fee in advance greater than—

        (a)     the equivalent of one month's fees; or

        (b)     if an amount is prescribed for the purposes of this subsection, that prescribed amount.

Penalty:     60 penalty units, in the case of an individual;

    300 penalty units, in the case of a body corporate.
