SOCIAL SERVICES REGULATION ACT 2021 (NO. 37 OF 2021) - SECT 315

Evidentiary certificates

In any proceeding for an offence under this Act or the regulations, a certificate signed by the Regulator or an authorised officer stating any of the following is evidence that—

        (a)     a stated document is one of the following made, approved, given or issued under this Act or the regulations—

              (i)     a record of a registration;

              (ii)     guidelines or a code of compliance;

              (iii)     an improvement notice or a prohibition notice;

              (iv)     a record of information in the Register;

              (v)     a prescribed document;

        (b)     a stated document is a copy of a thing referred to in paragraph (a);

        (c)     on a stated day, or during a stated period—

              (i)     a stated person was appointed as an authorised officer; or

              (ii)     a stated person was a registered social service provider; or

              (iii)     a registration was subject to a stated condition; or

              (iv)     a registration was suspended or cancelled; or

              (v)     a stated person was an insolvent under administration;

        (d)     a stated amount is payable under this Act or the regulations by a stated person and has not been paid.
