SOCIAL SERVICES REGULATION ACT 2021 (NO. 37 OF 2021) - SECT 48

Notifiable incidents

    (1)     Subject to subsections (2) and (3), a registered social service provider, as soon as reasonably practicable, must notify the Regulator of any serious incident that has occurred, or may pose a serious risk to service users, during the delivery of a social service.

Penalty:     60 penalty units, in the case of an individual;

    300 penalty units, in the case of a body corporate.

    (2)     For the purposes of subsection (1), serious incidents include—

        (a)     an incident that results in serious harm to a service user or WCES service user; and

        (b)     an incident that is reasonably likely to cause serious harm to a service user or WCES service user; and

        (c)     any other prescribed incident.

    (3)     A notice under subsection (1) must—

        (a)     be given in the manner approved by the Regulator; and

        (b)     include any prescribed information.

    (4)     The Regulator may exempt a registered social service provider or class of registered social service providers from the notice requirement under subsection (1) if the Regulator is satisfied that the registered social service provider or class of registered social service providers are required to give notice of the relevant incidents to another State or Commonwealth regulator or public entity.
