ENVIRONMENT PROTECTION REGULATION 2005 - REG 50

Discharge of stormwater into receiving waters

    (1)     A person commits an offence if—

        (a)     the person discharges stormwater from—

              (i)     a sediment retention dam; or

              (ii)     footings; or

              (iii)     another stormwater retention area; and

        (b)     the stormwater flows into receiving waters; and

        (c)     the suspended solids concentration in the stormwater is higher than 60mg/L.

Maximum penalty: 10 penalty units.

    (2)     An offence against this section is a strict liability offence.

    (3)     In this section:

"receiving waters" means ground water or a waterway.
