CIVIL AVIATION SAFETY REGULATIONS 1998 - REG 141.295

Part 141 operators--carriage of passengers prohibited during abnormal operations or low - flying flight training

  (1)   A Part   141 operator commits an offence if:

  (a)   during a flight of an aircraft for authorised Part   141 flight training for the operator:

  (i)   a simulated engine or system failure that affects the aircraft's performance or handling characteristics is conducted; or

  (ii)   low - flying flight training is conducted; and

  (b)   a passenger is carried on the flight.

Penalty:   50 penalty units.

  (2)   An offence against this regulation is an offence of strict liability.
