Duty of officers and staff to disclose pecuniary interests
185 Duty of officers and staff to disclose pecuniary interests
(1) A person who is an officer or member of staff of an
Aboriginal Land Council must disclose the nature of a pecuniary interest in a
matter if-- (a) the Council is considering or discussing the matter, and
(b)
the person is present at a meeting of the Council, or the Board of the
Council, at which the matter is being considered or discussed.
(2) The person
must make the disclosure to the meeting as soon as practicable.
(3) The
disclosure must be recorded in the minutes of the meeting.
(4) Unless the
Aboriginal Land Council decides otherwise, the person must not be present at,
or in sight of, the meeting of the Aboriginal Land Council-- (a) when the
matter is being considered or discussed by the Council, or
(b) when the
Council is voting on a question in relation to the matter.
(5) A person does
not breach this section if the person did not know and could not reasonably be
expected to have known that the matter considered or discussed was a matter in
which the person had a pecuniary interest.
