Conduct of proceeding by Magistrates Court outside district or division
15A Conduct of proceeding by Magistrates Court outside district or division
(1) This section applies if— (a) a Magistrates Court (the
"original court" ) has jurisdiction under this Act or another Act to hear a
bail proceeding; and
(b) a practice direction made by the Chief Magistrate
provides for a bail proceeding to be heard by an alternative court under this
section.
(2) The bail proceeding may be heard by the alternative court under
an Act mentioned in subsection (1) (a) as if the alternative court— (a) had
jurisdiction to hear the bail proceeding; and
(b) were the original court for
the purpose of that Act.
(3) In hearing the bail proceeding, the
alternative court may make any order for the disposition of the charge the
court considers necessary.
(4) In this section—
"alternative court" means a Magistrates Court for a district or division
outside the district or division in which the bail proceeding would otherwise
be required to be heard.
