CHILD PROTECTION (OFFENDER REPORTING AND OFFENDER PROHIBITION ORDER) ACT 2004 - SECT 10
Conviction defined
(1) A reference to a
"conviction" in relation to an offence (however expressed) committed by a
person is a reference to any of the following, whether or not a conviction is
recorded— (a) a court making a formal finding of guilt in relation to the
offence;
(b) a court convicting the person of the offence, if there has been
no formal finding of guilt before conviction;
(c) a court accepting a plea of
guilty from the person in relation to the offence;
(d) a court accepting an
admission of guilt from the person in relation to the offence for the purpose
of the offence being taken into account under the
Penalties and Sentences Act 1992 , section 189 or the Youth Justice Act 1992 ,
section 157 , or under equivalent provisions of the laws of a foreign
jurisdiction.
(2) However, a reference to a conviction does not include a
conviction that is later quashed or set aside by a court.
