Disclosure required or permitted by law
143 Disclosure required or permitted by law
(1) A designated person may disclose confidential information if the
disclosure is required or permitted by an Act or law.
(2) Without limiting
subsection (1) , the disclosure of the following confidential information is a
disclosure permitted by an Act— (a) information provided to the chief
executive by a Service under a service agreement;
(b) information provided to
the chief executive and other entities by a Service in compliance with a
health service directive;
(c) information provided under this Act by the
chief executive to the Commonwealth or an entity established under an Act of
the Commonwealth;
(d) information provided to the administrator under part 3A
, division 4 ;
(e) information provided to a prescribed health professional
by a designated person by giving the prescribed health professional access to
a prescribed information system for the purposes of section 161C .
(3) A
prescribed health professional may disclose confidential information if the
disclosure is required or permitted by an Act or law.
