RESIDENTIAL TENANCIES AND ROOMING ACCOMMODATION ACT 2008 - SECT 308I
Confidentiality
308I Confidentiality
(1) This section applies to any of the following persons who have had access
to relevant information in relation to a notice ending tenancy interest— (a)
the lessor;
(b) the lessor’s agent;
(c) a person (an
"employee" ) who has access to the relevant information in the course of the
person’s employment by the lessor or lessor’s agent.
(2) The person must
not disclose the relevant information to anyone except in the following
circumstances— (a) the lessor disclosing the relevant information to the
lessor’s agent;
(b) the lessor’s agent disclosing the
relevant information to the lessor;
(c) an employee of the lessor or
lessor’s agent disclosing the relevant information to the lessor or agent;
(d) the person disclosing the relevant information to a lawyer while obtaining
legal advice;
(e) the person disclosing the relevant information in a
proceeding in a court or tribunal;
(f) the person disclosing the
relevant information as required by a law.
Penalty— Maximum
penalty—100 penalty units.
(3) In this section—
"relevant information" , for a notice ending tenancy interest, means— (a)
evidence supporting the notice; or
(b) personal information about the tenant
who gives the notice, including information about the tenant’s intention to
vacate the premises.
