282—Ability of occupiers to carry out works
(1) If an owner of
land fails to carry out work which a council has required the owner to carry
out under an Act, an occupier of the land may, with the approval of the
council, cause the work to be carried out.
(2) Subject to an
express provision in an agreement between the owner and the occupier, a person
who carries out work under subsection (1) may—
(a)
recover expenses incurred in carrying out the work from the owner of the land;
and
(b) if
the person is a lessee or licensee of the owner of the land—set off
expenses incurred in carrying out the work against a liability under the lease
or licence.
