LAND TITLES ACT 1980 - REG 67

Powers in lessor
In every memorandum of lease the following powers shall be implied in the lessor, unless otherwise provided in that memorandum:
(a) the lessor may, or the lessor’s agents may, at all reasonable times, enter upon the demised property, and view the state of repair of the demised property, and may serve upon the lessee, or leave at the lessee’s last or usual place of abode, or upon the demised property, a notice in writing of any defect, requiring the lessee, within a reasonable time to be specified in the notice, to repair the demised property;
(b) where the rent or any part of the rent is in arrears for 90 days, or where default is made in the fulfilment of any covenant, whether expressed or implied in that lease, on the part of the lessee, and is continued for 90 days, or where the repairs required by the notice referred to in paragraph (a) have not been completed within the time specified in the notice, the lessor may re-enter upon and take possession of the demised property.
