(1) The Recorder, on proof to the Recorders satisfaction shall record the re-entry as prescribed.(a) of lawful re-entry and recovery of possession by a lessor; or(b) that the lessee has abandoned the demised property, and that the lessor has re-entered and occupied the property personally or by tenants undisturbed by the lessee (2) Where a re-entry is recorded pursuant to subsection (1) the lease shall determine without prejudice to any action or cause of action previously commenced or accrued in respect of any breach or non-observance of any covenant expressed or implied in the lease.
