ADMINISTRATION AND PROBATE ACT 1958 - SECT 70B

Definitions for this Part

In this Part

"acquisition authorisation order" means an order of the Court under section 70U;

"distribution agreement" means an agreement entered into between multiple partners of an intestate as to the distribution of the intestate's estate between those partners;

"distribution order" means an order of the Court under section 70ZD ;

"partner" of an intestate means the person's spouse, domestic partner or registered caring partner at the time of the intestate's death;

"partner's property election" means an election by the surviving partner of an intestate under section 70P;

"partner's statutory legacy" means the amount to which a partner is entitled under Division 3—

        (a)     as specified in section 70M(1); or

        (b)     as published from time to time by the Minister under section 70N ;

"real and personal estate" of an intestate means every beneficial interest (including rights of entry and reverter) of the intestate in real and personal estate which (otherwise than in right of a power of appointment or of the testamentary power conferred by statute to dispose of entailed interests) the intestate could have disposed of by will, if of full age and capacity;

"right to elect notice" means a notice under section 70Q.
