CHILDREN, YOUTH AND FAMILIES ACT 2005 - SECT 158

Review by Victorian Civil and Administrative Tribunal

    (1)     Any of the following may apply to VCAT for review of a decision made under or in relation to a child care agreement relating to the care of a child

        (a)     the child;

        (b)     a parent of the child;

        (c)     any other person whose interests are affected by the decision.

    (2)     An application for review must be made within 28 days after the later of—

        (a)     the day on which the decision is made;

        (b)     if, under the Victorian Civil and Administrative Tribunal Act 1998 , the person requests a statement of reasons for the decision, the day on which the statement of reasons is given to the person or the person is informed under section 46(5) of that Act that a statement of reasons will not be given.

    (3)     Before a person is entitled to apply to VCAT for the review of a decision referred to in subsection (1), the person must have exhausted all available avenues for the review of the decision under section 157.
