NUCLEAR ACTIVITIES (PROHIBITIONS) ACT 1983 - SECT 9

Prohibitions against possessing etc. nuclear material

    (1)     A person shall not—

        (a)     have in his possession;

        (b)     use;

        (c)     sell;

        (d)     transport;

        (e)     store; or

        (f)     dispose of by any means—

any nuclear material unless, in respect of the nuclear material concerned—

        (g)     the person holds a management licence or use licence (as the case requires) to do so;

        (h)     the person may do so under an exemption under section 16 of the Radiation Act 2005 ;

              (i)     he has complied with section 113 of the Mineral Resources (Sustainable Development) Act 1990 .

    (1A)     In subsection (1)(g) management licence and use licence have the same meaning as in the Radiation Act 2005 .

    (2)     A person who has in his possession, uses, sells, transports, stores or disposes of nuclear material in breach of the provisions of subsection (1), shall be guilty of an offence and liable to a penalty of not more than 50 penalty units and in the case of a continuing offence to a daily penalty of not more than 20 penalty units for each day the offence continues after conviction.

    (3)     Proceedings for an offence against this section shall be taken before the Magistrates' Court.
