ROAD SAFETY ACT 1986 - SECT 22

Learner permits


S. 22(1) amended by Nos 5/2016 s. 36(Sch.  1 item 7(a), 49/2019 s. 116(Sch.  1 item 42(a)).

    (1)     The Secretary may, on the application of a person over the prescribed age, grant a learner permit if the Secretary is satisfied that the applicant is qualified to hold a learner permit.

    (2)     In subsection (1), "prescribed age" means—

        (a)     in the case of a learner permit to drive a motor cycle, 18 years; and

S. 22(2)(b) amended by No. 5/1990
s. 6.

        (b)     in any other case, 16 years.

    (3)     The Secretary may, before granting a learner permit, require the applicant—

S. 22(3)(a) amended by No. 5/2016 s. 37(Sch.  2 item 4).

        (a)     to pass any appropriate tests or assessments and undergo any appropriate training; and

        (b)     to comply with any prescribed procedures and requirements.

    (4)     A learner permit authorises the holder to drive on a highway any category of motor vehicle indicated in the permit for the term and subject to the conditions specified in the permit.

    (5)     A learner permit may be applied for, granted, renewed, extended or refused only in accordance with the regulations.

    (6)     A person who holds a learner permit must have the permit in his or her possession at all times while driving or in charge of a motor vehicle.
