FISHERIES REGULATIONS 2009 (SR NO 2 OF 2009) - REG 84

Use and possession of hand-held spear not permitted in certain waters

r. 84

    (1)     A person must not use or possess a hand-held spear in or on—

        (a)     inland waters; or

        (b)     the waters of Corner Inlet, the North Arm of the Gippsland Lakes, Lake Tyers, Mallacoota Inlet, Sydenham Inlet, Swan Bay, Tamboon Inlet, Wingan Inlet or Curdies Inlet; or

        (c)     the waters that are within 30 metres from any jetty or the mouth of any creek or river.

Penalty:     20 penalty units.

    (2)     Subregulation (1) does not apply to a person who uses or possesses a hand-held spear in or on the waters of Corner Inlet east of a line from the mean high water mark on the most northerly point of Entrance Point (on Wilson's Promontory) to the most westerly part of Little Snake Island at the mean high water mark then following the coastline of Little Snake Island generally north and then east to a point directly south of the long jetty at Port Welshpool and then on a north-south line to the end of that jetty and along the jetty to the shore.

    (3)     Subregulation (1) does not apply to a person who possesses a hand-held spear in a boat that is proceeding by the most direct route to or from a boat ramp or mooring to waters in which the use of a hand-held spear is permitted.
