CRIMINAL CODE 1899 - SECT 320A
Torture
(1) A person who tortures another person commits a crime. Penalty—
Maximum penalty—14 years imprisonment.
(1A) The
Penalties and Sentences Act 1992 , section 161Q states a circumstance of
aggravation for an offence against this section.
(1B) An indictment charging
an offence against this section with the circumstance of aggravation stated in
the Penalties and Sentences Act 1992 , section 161Q may not be presented
without the consent of a Crown Law Officer.
(2) In this section—
"pain or suffering" includes physical, mental, psychological or emotional
pain or suffering, whether temporary or permanent.
"torture" means the intentional infliction of severe pain or suffering on a
person by an act or series of acts done on 1 or more than 1 occasion.
