TRANSPORT OPERATIONS (ROAD USE MANAGEMENT--ROAD RULES) REGULATION 2009 - REG 242

Travelling in or on a wheeled recreational device or toy on a footpath or shared path

242 Travelling in or on a wheeled recreational device or toy on a footpath or shared path

(1) Subject to subsection (1A) , a person travelling in or on a wheeled recreational device or wheeled toy on a footpath or shared path must—
(a) keep to the left of the footpath or shared path unless it is impracticable to do so; and
(b) give way to any pedestrian (except a person travelling in or on a wheeled recreational device or wheeled toy) who is on the footpath or shared path.
Penalty—
Maximum penalty—20 penalty units.
(1A) Subsection (1) does not apply to a person travelling in or on a wheeled recreational device or wheeled toy on a footpath if a local law prohibits the travelling.
(2) A
"shared path" is an area open to the public (except a separated footpath) that is designated for, or has as 1 of its main uses, use by both the riders of bicycles and pedestrians, and includes a length of path for use by both bicycles and pedestrians beginning at a shared path sign, or shared path road marking, and ending at the nearest of the following—
(a) an end shared path sign or end shared path road marking;
(b) a no bicycles sign or no bicycles road marking;
(c) a bicycle path sign or bicycle path road marking;
(d) a road (except a road-related area);
(e) the end of the path.
(3) In this section—

"end shared path road marking" means a shared path road marking that includes the word ‘end’.

"shared path road marking" means a road marking consisting of a pedestrian symbol above a bicycle symbol.
