CHILDREN, YOUTH AND FAMILIES ACT 2005 - SECT 7H

Role of recognition principles

    (1)     The recognition principles are intended—

        (a)     to give guidance in the administration of this Act; and

        (b)     to ensure that the distinct cultural rights of Aboriginal children and Aboriginal families and the right of Aboriginal people to self-determination are recognised, respected and supported.

    (2)     The recognition principles apply subject to section 10.

    (3)     The recognition principles

        (a)     apply in addition to the principles in Divisions 3 and 4 of Part 1.2; and

        (b)     do not limit the principles in Divisions 3 and 4 of Part 1.2.

    (4)     Nothing in this Part applies in relation to any decision or action under Chapter 5 or Chapter 7 (in relation to any matter under Chapter 5).
