When water diverted to any land onus of proof of non-complicity lies on owner or occupier of land

128. When water diverted to any land onus of proof of non-complicity lies on
owner or occupier of land

Whenever it is shown that any water is or has been so wrongfully taken or used
or illegally diverted or taken to or into land owned or occupied by any person
the taking or using or diversion of such water shall be deemed to have been
effected by or by the direction of such person unless such person satisfies
the court that such taking or using or diversion of the water on to or into
such land was effected without his direction or connivance. __________________
